Abstract: Section 106 of the National Historic Preservation Act, codified in 36 CFR 800, comes into play when a project involves federal assistance, such as federal permitting, licensing, or funding. You may be familiar with the key terms — identification of historic properties, public involvement, government-to-government consultation, mitigation of adverse effects — and the complex process. But how do you get through project reviews more smoothly with fewer delays? Learn about special circumstances, geophysical technologies, maritime archaeological considerations, and some hard-won lessons from a (slightly) grizzled former archaeology consultant and current State Historic Preservation Office Section 106 reviewer.
